Terms of Service
By using sensemakingwith.ai (the "Service"), you ("you," "User") agree to these Terms of Service ("Terms"). The Service is provided by 834770 Alberta Ltd. ("we," "us," "our"), an Alberta, Canada corporation operating as sensemakingwith.ai, subject to the conditions below.
1. The Service
sensemakingwith.ai is a collaborative platform for using strategic-thinking frameworks (SWOT, Wardley Mapping, Cynefin, OKRs, and others). We provide it on an "as-is, as-available" basis, meaning we work hard to keep it operational but don't guarantee uninterrupted service.
2. Accounts
You may use the Service without an account (anonymous, with limited functionality), or sign in via a supported OAuth provider or magic link. You're responsible for keeping your sign-in credentials safe and for activity on your account.
You must be at least 13 (US, Canada) or 16 (EU/EEA/UK) to use the Service. If you're using it on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. Acceptable use
You agree not to:
- Use the Service for any illegal purpose or to violate any applicable law
- Infringe anyone else's intellectual property, privacy, or other rights
- Send spam, phishing, malware, or other unwanted content via the Service (including via share links or comments)
- Reverse-engineer, scrape, or attempt to gain unauthorized access to non-public parts of the Service
- Interfere with or disrupt the Service's operation, including via excessive automated requests
- Impersonate any person or organization
- Resell, sublicense, or redistribute the Service without our written permission
We may suspend or terminate accounts that violate these rules.
4. Your content
You own everything you create in the Service. By using the Service, you grant us a limited, non-exclusive license to host, store, transmit, and display your content as needed to operate the Service (e.g., showing it to people you've shared with, syncing it across your devices, backing it up). This license ends when you delete your content or your account.
You're responsible for the content you create. We don't review every file, but we reserve the right to remove content that clearly violates these Terms or applicable law.
5. Our content
The Service itself — software, designs, framework explanations, marketing copy — is owned by us and licensed to you only as needed to use the Service. Frameworks themselves (SWOT, Wardley Mapping, etc.) are public methodology and not owned by anyone.
6. Paid plans
If you subscribe to a paid plan, our merchant of record, Polar, charges your payment method on a recurring monthly basis until you cancel. You can cancel anytime; your plan stays active through the end of the paid month, and we don't offer partial-month refunds. The free tier is the trial period; we don't offer separate trials.
We may change pricing with at least 30 days' notice. New pricing applies at your next renewal — your current period stays at the rate you signed up at.
7. Cancellation and termination
You may cancel your account at any time from Settings. The remaining paid period stays available until the end of the cycle you've paid for. After cancellation, your data is soft-deleted for 30 days then permanently removed (you can re-activate within that window by contacting support).
We may terminate or suspend your account if you violate these Terms, if your payment fails after multiple retries, or if continued service would be illegal in your jurisdiction.
8. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied. We don't warrant that the Service will be error-free, uninterrupted, secure, or that it will meet your specific needs.
The frameworks themselves are tools for thinking. We don't guarantee that following any framework will produce a particular business outcome.
9. Limitation of liability
To the fullest extent permitted by law, our total liability arising out of or related to the Service in any 12-month period is limited to the amount you paid us during that period (or CAD $100, whichever is greater for free-tier users).
Neither party is liable for indirect, incidental, consequential, or punitive damages, even if advised of the possibility of such damages. Some jurisdictions don't allow these limitations; in those cases, the limitations apply to the maximum extent permitted.
10. Indemnification
You agree to defend and indemnify us from third-party claims arising out of your content, your violation of these Terms, or your violation of applicable law.
11. Governing law
These Terms are governed by the laws of the Province of Alberta, Canada, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the courts of Alberta for any dispute. If you're an EU/EEA/UK consumer, mandatory consumer-protection laws of your country still apply; nothing in these Terms removes rights you have under those laws.
12. Changes
We may update these Terms as the Service evolves. Material changes will be announced via in-app notification and email at least 30 days before they take effect. Continuing to use the Service after the effective date constitutes acceptance of the updated Terms.
